Terms of service

Applicability

  •  These general terms and conditions apply to all offers, orders and agreements between Ooh My Light and the customer through online purchase at www.oohmylight.com
  •  By accepting an offer or placing an order, the costumer declares to agree with these General Terms and Conditions.

Offers / agreements

  • If an offer has a limited validity, Ooh My Light will state this clearly.
  • Ooh My Light will describe its products  accurately and truthfully.
  • Ooh My Light will clearly state in its offers the rights and obligations of the consumer when he accepts an offer. This includes indication of the price, delivery costs, payment method and the right of withdrawal.
  • Ooh My Light is entitled to refuse an order without giving a reason. There is only an agreement once Ooh My Light has accepted the order.

Right of withdrawal

  • After purchase, the customer has the right to return an item, without giving a reason, within fourteen days, starting on the day of receipt by the customer. If an item by its nature does not fall under the right of withdrawal, this will be stated by Ooh My Light in the offer.
  •  During the trial period, the customer must handle the product and the packaging with care. If the customer wishes to return an article on the grounds of the right of withdrawal, product must be unused, undamaged and in the original packaging. A seal may not be broken. The consumer must ensure proper packaging of the return shipment and pay shipping costs.
  • When returning in accordance with the conditions and within the trial period, Ooh My Light will refund the purchase amount within 30 days.

Prices and payments

  •  All prices for the products or services offered are in Euros, including VAT and excluding shipping costs. Shipping costs are stated separately.
  • Payment must be made using a payment method offered by Ooh My Light. When paying by bank transfer, the day of payment is the day on which the amount is credited to the account of Ooh My Light.
  • Payment must be made immediately after placing an order. When the amount owed has been received by Ooh My Light, the order will be processed.
  •  If the consumer fails to pay , Ooh My Light is entitled to postpone or terminate the agreement in question.
  • If you return a sale item the sale price will be refunded to customer.
  • If the discount code that is not intended for this is abused, the entire order will be canceled and the amount refunded to the account known to us.

Delivery

  • The stated delivery times for the products are indicative with a maximum delivery time of 30 days. Exceeding the stated delivery time does not give the customer the right to compensation or cancellation of the order, unless the delivery time is so long that the customer cannot reasonably be expected to uphold the agreement. In that case, Ooh My Light will return the purchase amount to the consumer within 30 days.
  • The delivery address is the address given by the customer. 
  • Deliveries are only made to countries that are specified by Ooh My Light. 

Conformity and guarantees

  • Ooh My Light ensures that ordered products comply with the agreement, the specifications stated in the offer and with reasonable requirements of usability and reliability.
  •  If, due to its nature, a product is delivered under warranty and a defect occurs within the warranty period, the customer must notify Ooh My Light in writing or via e-mail. Ooh My Light will take back the item for repair or replace it, provided that the defect was not caused by improper use. The choice for repair or replacement lies with Ooh My Light.
  • The warranty is limited to the period of 3 months.

Complaints and liability

  • The customer must check an article as soon as possible upon receipt. Any defects or transport damage must be reported to Ooh My Light in writing or via e-mail within 7 days of receipt.
  • After receiving the complaint, Ooh My Light will either replace the items, or return the purchase amount, after they have been returned.
  • If an article does not meet the quality standards that can reasonably be set for it under normal use, the customer can inform Ooh My Light  in writing or via e-mail and Ooh My Light will assess the complaint and, if necessary, the relevant article repair or replace.

Applicable law and competent court

  • Dutch law applies to every agreement between Ooh My Light and the customer, even if the products have been delivered abroad.
  • Ooh My Light and the customer will only appeal to the courts after they have made every effort to settle a dispute in mutual consultation.
